As in many other European jurisdictions, Romanian insolvency proceedings are court led, namely contentious, entailing a certain inflexible, however natural sequence of stages, imposing on both debtor and creditors mandatory procedural deadlines.
The opening of the insolvency proceeding is definitely not a risk-free strategy but, in order to mitigate such risks, setting the insolvency milestones is crucially important for the debtor and creditors to exercise their prerogatives and preserve their rights and interests, aiming for the debtor’s successful reorganization and reinsertion in the economic circuit and the creditors’ claims’ recovery.
