COVID -19 spreads rapidly in Romania and globally. Every one of us passes a very difficult period, never met before. The health system is the most exposed and the doctors, those in the front line of intervention, need all our support.

Save the Children Romania has strong connections with the medical system, developed through the direct and concrete support we have offered over the last 9 years. We stay beside the doctors and we understand the gravity of the situation we are facing: the lack of protection equipment, of the equipment for emergency departments, pediatrics units, maternity and new-born babies wards.

We have already started working with the doctors at Alessandrescu-Rusescu  National Institute for the Health of Mothers and Children – Bucharest for extending, fitting out and equipping the emergency departments for children. Yesterday we have equipped Bucur Maternity Hospital, that is assigned by the authorities to receive and treat pregnant women with Covid19. We are working to meet the requests received from 48 medical units in Bucharest and around the country.

We have launched a 3 million euro call for action in order to meet the doctors’ needs.

We have allotted a special account for this Emergency Fund for Hospitals.

  1. SUBJECT MATTER OF THE AGREEMENT

ART. 1. The subject matter of the agreement is the provision by the SPONSOR of the amount of ……………………… RON, that is to be used to create an emergency fund for the improvement of the Romanian medical system, particularly of the intensive care and pediatrics units, maternity and new-born babies wards.

  1. RIGHTS AND OBLIGATIONS OF THE PARTIES

ART. 2.1. The SPONSOR shall provide the Beneficiary with the amount set out in art. 1 of this agreement, by bank transfer in the BENEFICIARY’s account no. RO43RNCB0071011434790083 (RON) opened with Banca Comercială Română, Plevnei subsidiary, by the date of 31 December 2020.

ART. 2.2. The BENEFICIARY shall use the sponsored amount for the purpose indicated in this agreement.

ART. 2.3. The SPONSOR or the BENEFICIARY shall make the sponsorship public in a way that does not harm, directly or indirectly, the sponsored activity, morals or public order and justice.

  1. TERM OF THE AGREEMENT

ART. 3. The term of the agreement starts on the signing date and ends on the date of 31 December 2020, with the possibility to be extended following the agreement of both parties.

E . CONFLICTS AND DISPUTES

ART. 4.1. The Parties have agreed that all misunderstandings regarding the validity of this agreement or resulting from its interpretation, execution or cessation are to be settled amicably by their representatives.

ART. 4.2.  In the event that the disputes cannot be settled amicably, the parties shall refer to the competent courts of law.

  1. PROCESSING OF PERSONAL DATA

ART. 5.1. The Parties shall process the personal data obtained in virtue of executing this Agreement in compliance with the principles provided by the data protection legislation (principle of legality, equity, transparency, accuracy, accountability, limitations related to purpose and storage). In the meaning of the provisions of this Agreement, the data subject to processing may refer to: last name, first name, position, e-mail address, telephone number.

ART. 5.2. The purpose of data processing is the performance of the provisions of this Agreement. Processing may not be extended to other purposes, except for the situation where the Parties expressly agree or there is a legal obligation that entitles the Party to process the data.

ART. 5.3. The Parties shall keep the confidentiality of personal data. Each of them shall guarantee that the access to the data subject to processing is enabled only to the employees in charge of the respective contractual relation.

ART. 5.4. Each of the Parties shall implement reasonable measures of physical, technical and administrative safety so as to prevent incidents such as the loss, improper use, unauthorized access, disclosure, alteration or destruction of the personal data. In the event of a data protection incident, each of the Parties shall notify it to the other Party within 24 hours.

ART. 5.5.  Neither Party shall communicate the personal data provided by the other Party to any third party, with the following exceptions (i) there are legal grounds or (ii) there are contractual grounds and the Party has given its agreement.

ART. 5.6. Upon the termination of the contractual relationship, the Parties shall cease the processing of personal data, except for the situations where (i) a legal obligation requires the continuation of the processing or (ii) rights in court and/or before the State authorities with control tasks are to be exercised, situations where the Parties shall be further bound to keep the confidentiality.

  1. CHILD SAFEGUARDING POLICY

The SPONSOR shall analyze and abide by Save the Children Romania Child Safeguarding Policy, which is available on Save the Children Romania website.

  1. FINAL CLAUSES

ART. 6.1. The amendment of this agreement shall be made only by addendum concluded between the contracting parties.

ART. 6.2. This agreement is the will of the parties and shall remove any other verbal understanding between them, prior or subsequent to its conclusion.

ART. 6.3. This Agreement was concluded in 2 counterparts, one for each contracting party.
