The trial period is a legal termination clause of the individual employment contract, which benefits both the employer and the employee.

In the recently published article, the authors Cătălina Dicu  – Senior Partner – și Anca Manolache – Managing Associate,  STOICA & Asociații – show that the right to terminate the employment contract during or at the end of the trial period cannot be exercised abusively by the employer, otherwise, based on the principle of good faith, the aggrieved party can initiate a litigation in court and thus cancel the decision regarding the termination of the employment.
